In Arizona, when a person is charged with driving under the influence (DUI), he/she will have to go through two legal proceedings:  the criminal proceeding and the civil proceeding.  The criminal proceeding takes place in court and the civil proceeding takes place at the Arizona Motor Vehicle Division.

The DUI process starts with the criminal proceedings.  During the criminal proceedings, the accused appears before the judge in court.  If the person is charged with a misdemeanor, his/her appearance may not be necessary if he/she has appointed legal counsel.  However, if the person was charged with a felony, he/she must appear in court.  At the initial appearance, the person’s charges will be read.  The charges will determine if the person can be released on bail or not.

After the initial appearance, a preliminary hearing will be held.  At the preliminary hearing, the judge will review the evidence presented by law enforcement and state prosecutors to determine if DUI charges are valid and may be pressed.  Following the preliminary hearing is the pretrial.  During the pretrial, the defense may negotiate with prosecutors to have the DUI charges reduced or dismissed.

The last step in the court process is the actual criminal trial.  At the trial, both the prosecution and defense may present evidence and challenge arguments.  The trial ends with a verdict of “guilty” or “not guilty”.  If the person is convicted (found guilty) of DUI, he she may be punished with jail time, monetary fines, probation, community service, mandatory drug and alcohol programs, and/or vehicle interlock devices.
