Pretrial Release From Jail |
With felony charges, at your initial appearance in Justice Court, the
judge sets the amount of your bail and the conditions of your release.
If you are being held on a bail or bond, we may be able to file a
motion to reduce bail. Here are the factors that the judge will
consider:
- the seriousness of the offense
- your past criminal record, if any
- whether you are employed
- how long you have lived in the area and whether you have ties to the community
- the opposition from the County Attorney's Office (the prosecutor) or the "victim" if any
- drug, alcohol, and mental health issues (and possible treatment)
