After a sentencing, a criminal defendant who is not happy with what happened may be able to file a written appeal or petition. If you have a trial, are convicted, and then sentenced, you can file what is called and appeal. A notice of appeal must be filed within twenty (20) days from the sentencing date. If you plead guilty and are sentenced, you cannot file a direct appeal to the Court of Appeals. Instead, you can only file a Rule 32 Petition for Post-Conviction Relief (within ninety (90) days). The same judge will listen to your arguments and make a decision. If you lose, then you have a right to ask the Court of Appeals to look at your complaint.
