For any combination consisting solely of the drugs listed above, the threshold is an amount equal to or in excess of the threshold as determined by the application of ARS 13-3420. For any drug not listed above or any combination of drugs not listed above, the threshold is in an amount with the value of as least $1000.00
I AM CHARGED WITH POSSESSION FOR SALE OVER THE THRESHOLD. WHAT DOES THAT MEAN?
The reason the threshold amount is important is because if the State convicts you of any of the following: Drug Possession with intent to sell, manufacture, or distribute, Possession of Drug Paraphernalia, Drug Cultivation, Drug Manufacturing, Drug Smuggling, Drug Trafficking, Drug Distribution, or Drug Transportation, and you are over the threshold amount, then the judge must sentence you to prison and you are not eligible for probation or suspension of sentence. That provision is found in Arizona Revised Statute 13-3419.
However, if the police allege less than the threshold amount, then the suspect is still eligible for probation even if the charge is one of the ones listed above.
