I HAVE BEEN CHARGED WITH POSSESSION OF CRYSTAL METHAMPHETAMINE IN ARIZONA.  NOW WHAT?

Without question, crystal meth, or methamphetamines, is the drug that comes up the most in the Arizona justice system.

In Arizona state court, possession of meth is charged as possession of a dangerous drug. The threshold amount is 9 grams, which includes liquid suspension. There is a big difference between possesion for personal use and possession for sale of methamphetamine. The sentences for manufacture of methamphetamine in Arizona is very strict, much worse than other dangerous or narcotic drugs.

Under Arizona law, the possession of equipment or chemicals for the purpose to making meth carries with it special sentencing provisions.  For first offenses, the presumptive sentence is 10 years, with a minimum of five years and a maximum of 15. Second offenses carry heavier consequences - as much as 20 years with no eligibility for parole.

CAN I BE CHARGED IN FEDERAL COURT FOR METHAMPHETAMINE POSSESSION?

Yes, the US Attorneys' Office can also charge someone in federal court for illegal drug possession. Authorities consider methamphetamines such a problem that the US Congress is considering "The Combat Meth Act", which would, among other things:

* classify pseudoephedrine as a Schedule V drug, meaning products containing pseudoephedrine must be kept behind a pharmacy counter and sold only by a pharmacist or pharmacy technician (Feinstein Press Release);
* require customers to present proof of identification and to sign a written log containing the date of the transaction, the name of the buyer, and the amount of the substance purchased;
* limit consumers to buying only nine grams of products containing pseudoephedrine over a thirty-day period; and
* create Special Assistant U.S. Attorney positions under which prosecutors could bring legal action against manufacturers and distributors in federal court.
