You do not have to answer the police officer's questions. If the police officer asks you how much you had to drink, you do not have to give him answer. You do not have to undergo the police officer's FSTs. If the police officer asks you "can I look in your eyes to see if your Ok to drive?" you can tell him "no". Keep in mind police officers are very clever in how they ask their questions. They will never tell you that they are gathering evidence against you. They will always couch their requests to make it look like they are only trying to help you. Also, if the police officer asks you to submit to a portable breath test or PBT, you don't have to. A PBT is not the same thing as the Intoxilyzer, however. Keep that in mind while reading the information below.

But if the police officer decides to arrest you and then reads the Admin Per Se form to you, then the government can force you to give up your blood or breath for a chemical test. Just as scary, if you do agree to the blood draw, the police officers will probably draw your blood on the side of the road.
