Firm Overview | Vladimir Gagic PLLC

If you are facing a Phoenix Drunk Driving charge, you could be facing some extremely severe penalties, which could include license suspension or revocation, jail time, fines, and an interlock device, and not to mention the social stigma and professional consequences as well. These cases can become very difficult and it is important to have an experienced drunk driving defense attorney on your side to help protect your interests and guide you through the process.

My Only Job is to Protect Your Rights in Drunk Driving Cases

When any Police officer stops you, they must have reasonable suspicion to make the stop. Reasonable suspicion can mean violation of a traffic law, equipment failure, or reasonable suspicion that a crime has been committed. Many times Police Officers fudge or allege things that just are not true. They do that because they have no intention of doing anything but stopping as many drivers as possible with the hopes of catching someone they will allege is driving drunk.

When you hire my firm, it is my responsibility to defend you to the best of my ability. That means I will look at the evidence closely to determine where the Police have made mistakes. Among other things, that includes:

  • Whether the law enforcement official had reasonable suspicion to stop you
  • If the Police office properly administered the breath test
  • If the person who administered the breath test was qualified to do so
  • If the breath test equipment was accurate and working properly
  • Whether the Police officer had probable cause to arrest you

You Do Not Have to Take the Portable Breath Test if Stopped for a DUI Investigation

You have the right to refuse the roadside breath test. That is what the Police Officers call the Portable Breath Test (PBT), and in any event, the results of the PBT are not admissible. You also do not have take the Police Officer's field sobriety tests.
