The penalties for a super extreme DUI are much more severe than the other types of misdemeanor DUIs. For example, the minimum time in custody for a first time super extreme DUI is 45 consecutive days in jail, and the fines and fees add up to about $7,000.

For a second misdemeanor DUI charge within 7 years of a prior misdemeanor DUI, if the second one is a super extreme DUI then the statutory sentence is the maximum sentence for any misdemeanor in Arizona, 6 months in custody. Statutory means that the judge does not have the right to give a defendant a more lenient sentence.
