The State of Arizona has a vested interest in keeping its citizens safe, and punishing those who violate laws prohibiting drunk driving. Hundreds of people each year are killed in drunk driving accidents each year in the state. With that, the legislature has incorporated a number of DUI violations commensurate with a driver's blood alcohol level, as well as property damage and injuries that may have been caused in drunk driving accidents.

Drivers can be charged with DUI if they have a BAC over .08 while behind the wheel of a car or within two hours of driving a vehicle. This is a class 1 misdemeanor punishable with one day in jail and up to $750 in various fines. Violators also face suspension of their driver's license for up to 90 days and five years of probation.

Drivers can be charged with Extreme DUI if they have a BAC over .15 (which is nearly double the legal limit) while driving a car or within two hours of doing so. The penalties include up to 30 days in jail, a $250 fine plus additional surcharges, $250 for a DUI assessment, an additional $1000 assessment to the state prison fund, and a $1000 assessment to the state public safety fund.

Those convicted of Extreme DUI may face administrative penalties as well. They may have their license suspended for at least 90 days, and their car may be impounded for 30 days. They are also responsible for impound fees. Once their driving privileges are reinstated, offenders must also install (and maintain) an ignition interlock device on their vehicle at their own expense for one year.

Arizona law also includes harsh penalties for Super Extreme DUI (BAC over .20).
